These Terms and Conditions (“Terms”) govern your use of the NC Bourbon Insider website, services, alerts, content, boards, blog, and subscriptions (collectively, the “Service”), owned and operated by Fision Analytics, LLC (“Company,” “we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

NC Bourbon Insider is an informational alert platform and whiskey content community. We provide community-sourced reports, data aggregation, blog content, saved boards, favorites, and subscription-based notifications regarding whiskey and bourbon availability at retail locations.

We are NOT:

  • A retailer
  • A distributor
  • A seller of alcohol
  • Affiliated with any ABC store or retailer
  • A real-time verified inventory system

2. No Guarantee of Accuracy or Availability

Inventory changes rapidly. Information delivered via the website, email, or SMS may be delayed, outdated, or inaccurate. You acknowledge:

  • Products may be sold out before arrival
  • Store policies may change without notice
  • Travel and purchase decisions are made at your own risk

3. Age Requirement - 21+ Only

You must be at least 21 years old to use this Service.

4. Subscription Terms & Billing

  • Subscriptions auto-renew unless canceled
  • You are responsible for managing your subscription
  • No refunds for partial billing periods
  • Pricing may change with notice

5. Compliance with Alcohol Laws

You are solely responsible for complying with all alcohol laws. We do not encourage unlawful resale, transport, or distribution.

6. SMS Alerts, Phone Verification & TCPA/CTIA Consent

If you provide your phone number, you consent to receive:

  • A one-time verification SMS
  • Recurring automated promotional and informational alert messages if you opt in

Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Reply STOP to cancel or HELP for help. You may also manage SMS preferences in your account settings.

7. User Data & Features

We collect:

  • Email
  • Phone number
  • Favorite bottles
  • Saved boards
  • Usage activity

We do not sell personal data.

8. Blog, Reviews, and Opinions

All content is opinion and for informational/entertainment purposes only.

9. Limitation of Liability

Fision Analytics, LLC is not liable for any damages from reliance on the Service.

10. Indemnification

You agree to hold Fision Analytics, LLC harmless from claims arising from your use.

11. Intellectual Property

All content, alerts, boards, and data belong to the Company.

12. Personal Use Only - No Redistribution or Echoing of Alerts

Alerts and other Service content are licensed to you for your own personal, non-commercial use only. Your subscription is a limited, revocable, non-transferable license and does not give you any right to share, resell, or republish alerts. Redistribution or “echoing” of alerts is strictly forbidden. Without our prior written permission, you may not:

  • Forward, repost, copy, screenshot, summarize, or otherwise republish alerts (in whole or in part) to any other person, group, list, or audience, including group texts, email lists, Discord or Slack servers, Telegram or WhatsApp channels, Facebook groups, social media accounts, websites, or apps
  • Build, use, or operate any bot, script, automation, webhook, forwarding rule, AI agent, or other tool that receives, reads, parses, relays, or re-sends alerts from the Service (for example, an email or SMS auto-forward, or a workflow tool that reposts alerts elsewhere)
  • Scrape, crawl, or use automated means to access or extract alerts, data, or other content from the website, emails, or SMS messages
  • Share your account, login, or alert destination (email address or phone number) with others, or route alerts to a shared inbox, number, or group
  • Use alerts or Service data to create, feed, or support any other alert service, feed, channel, or product, whether free or paid

We actively monitor for redistribution and may include unique identifiers in alerts so that any copy can be traced back to the account it was sent to. If we determine, in our sole discretion, that you have violated this section, we may immediately suspend or terminate your account and subscription without notice or refund, block you from creating new accounts, and pursue any remedies available to us under law, including injunctive relief and recovery of damages and attorneys’ fees.

Governed by North Carolina law.

14. Changes to Terms

We may update these Terms at any time.
